Welcome to Ultimate Jet Vacations (UJV)! By using our services, you agree to these Terms of Service ("Terms"). Please read them carefully. These Terms govern your use of UJV’s website, mobile and web-based applications, and other tools directly provided by UJV ("Services").

1. Nature of Our Services (Agency Role)

UJV acts as an independent intermediary and agent for the contracting of travel services (Travel-Products). We book travel services for independent, third-party travel, hospitality, and service providers ("Travel Providers").

• Vendor Terms: Any booking you make is subject to the respective Travel Provider’s terms and conditions, which may limit their liability and supersede our own where they conflict. Your remedy for a Travel Provider’s failure to provide services lies solely with that Travel Provider, not UJV.
• Booking Confirmation: UJV only confirms a booking once the full price is paid by you, the End Customer, and received by UJV. Prices and availability are subject to change before confirmation.

2. Account, Payment, Billing and Data Security

• Ultimate Jet Vacations (UJV) requires users to be responsible for their account confidentiality and to immediately report any security breaches. Payments for services are to be made in the currency specified in the booking confirmation, using credit/debit cards, wire transfers, or bank transfers, with the user accountable for the accuracy of the provided information.
• UJV, or its third-party payment processor, is authorized to store your Primary Account Number (PAN) or a secure, non-sensitive token ("Card-on-File"). This establishes UJV as your authorized agent to initiate charges for the initial services (including taxes and fees) and any subsequently agreed-upon services, fees, or charges (such as itinerary changes or upgrades) without requiring re-entry of your full card details. Explicit permission is granted for UJV to use the stored payment method for future related transactions, provided these charges are communicated in advance or at the time of service, establishing the legal basis for such payments.
• UJV is committed to the Payment Card Industry Data Security Standard (PCI DSS) and to securing your payment information. A compliant third-party processor is used to securely replace your card data with a non-sensitive token. In the event of an invalid payment (e.g., due to chargeback or fraud), you are obligated to reimburse UJV for the outstanding amount and any associated collection costs, including attorney fees.

3. Your Obligations and Prohibited Activities

• Travel Documentation: You are responsible for obtaining all necessary travel documentation, including passports, visa requirements, and compliance with entry/exit requirements for the country or countries visited.
• Itinerary Verification: Flight departure and arrival times are subject to change by Travel Providers; you must verify your itinerary.
• Group Bookings: Some bookings of 6 or more rooms ("Group Booking") are subject to confirmation by the Service Provider and may be modified or cancelled.
• Prohibited Conduct: You agree not to misuse our Services. Prohibited Activities include, but are not limited to:
  • Violating any applicable law or regulation.
  • Transmitting "junk mail," "spam," or similar solicitations.
  • Using automated devices (robot, spider) or manual processes to monitor or copy material on the Service.
  • Introducing viruses or harmful material, or attacking the Service (e.g., denial-of-service attack).
  • Disassembling, reverse engineering, or creating derivative works of any part of our Service.
  • Using our Service in competition with us or for benchmarking.
  • Holding room blocks (blocking multiple rooms with unconfirmed names and subsequent changes/cancellations).

4. Disclaimers, Liability, and Travel Risks

• AS-IS Service: The Services and Content are provided “as-is” and “as-available” without warranties. We do not guarantee the accuracy, truth, quality, suitability, or reliability of any third-party information or pricing. Obvious errors or mistakes (including pricing or typographical errors) are not binding, and UJV reserves the right to cancel the booking or modify the tariff after notice.
• Assumption of Risk: It is your personal decision to travel, and you must expressly assume all inherent risks of travel, including, but not limited to, risk of injury or death from vehicle collisions, illness, criminal acts, or accidents without medical services. UJV has no special knowledge of dangers at destinations.
• Force Majeure: Neither party is liable for failure or delay caused by events reasonably beyond its control, including civil turmoil, acts of God, or health-related crises (e.g., pandemic or epidemic). If a booking cannot be utilized due to force majeure, UJV will reimburse the unused portion but will not be responsible for the costs of any new travel product offered.
• Limitation of Liability: To the maximum extent permitted by law, UJV shall not be liable for any indirect, special, or consequential loss (including loss of profits). UJV’s entire liability shall not exceed the lower of: $100,000.00 or the sums paid by you to UJV in the twelve (12) months preceding the claim.

5. Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by the laws of the State of Florida.
• Informal Resolution: You must first contact info@ultimatejetvacations.com to attempt to resolve disputes informally within 30 days.
• Binding Arbitration: Any unresolved disputes shall be resolved by binding arbitration administered by the American Arbitration Association in Miami, Florida. By agreeing to arbitration, you waive the right to litigate in a court of law and to trial by jury. Claims must be brought individually, not as part of a class action.
• Time Limit for Claims: Any claim relating to these Terms or a Travel-Product must be noticed to UJV within thirty (30) days after the completion or end of the Travel-Product, and must be commenced within one (1) year after the cause of action accrues.
